1. Legal Information
Language used such as; ``you`` and ``your” outlines all persons as a group or specific, that are named on the booking list or quotes. This also includes those who might be added or substituted at a later date.
Everyone in the group is also included, although one person has only signed the booking form. This person is now representing the group and all members are still included until Partycroatia has been told directly to disinclude a particular personal.
``we`` and ``us`` means Partycroatia.
``supplier`` and ``representative`` outlines those that Partycroatia had contracts with. These are companies or persons handling and providing the activity or service that our customers request on our behalf.
2. We accept these following payment methods:
-T-com PayWay: American Express, MasterCard, Maestro, Visa
A non-refundable deposit will be required at the time of a booking. This deposit is an agreement between Partycroatia and person/group booking the deal, once deposit has been paid for, Partycroatia will reserve your spot and deal for you.
This deposit will be a minimum of 20% depending on the package being booked and unless stated otherwise.
The timeframe when the balance payable will be required will be stated to you upon the deal/booking confirmation. However full balance payable will need to paid for six weeks before depaturate/arrival date of the package deal booked.
-All payments made by credit card will incur a surcharge of 2% of the transaction value.
-No additional charges for payments by debit card.
-All payments made by cheque should be made payable to Partycroatia.
In the event that you do not pay for the product specified within the time limits specified by Partycroatia we reserve the right to cancel your booking on your behalf, or not to confirm the final booking with whom we have contracts with. In either case without further notification to you.
If this occurs then the initial deposit is non-refundable and the balance of any further money paid by you for the travel product will be dealt with in accordance with the operator's terms and conditions and any applicable law.
3. Payment receipt
Once deposit or payments have been finalised, depending on the chosen payment method, you will receive; confirmation of payment, detailed information on your reserved booking, invoice and calculation stating the amount which is to be paid directly to your host (only possible for some accommodation units).
Once payment of 100% of the amount has been finalised, you will receive the Bill specifying all payments made upon your deal and voucher containing the following:
-Name, address, and telephone number of service provider (legal or natural persons)
-Address (of apartment, hotel)
-Name and address of reservation holder (person who performs a reservation)
-Number of persons / names of guests who use the services named in the reservation
-Description of paid service, period / date of arrival and departure
-Note about the paid sojourn tax.
All cancellations must be received in writing immediately you are made aware to Partycroatia. Cancellation charges are as follows percentages, referring to the total price (fully paid package deals):
0-28 days before travel date - 100%
29-70 days before travel date - 50%
more than 71 days before travel date - loss of deposit
If you have the need to only cancel part of your booking or decrease the number of people in the party, then any relevant refund will only be paid once the entire booking has been recalculated and any changes in price taken into account.
Where possible we will accommodate any reasonable request to change your booking. However in a situation where you request to change your booking and you are not prepared to proceed with your travel arrangements as booked this will be treated as a cancellation. In this case cancellation charges stated above will need to be followed and paid.
Although it is unlikely that we will need to make changes or cancellations we reserve the right to do so at any time. Most of these changes will be minor and due to circumstances beyond our control. We shall inform you of such changes as soon as possible and offer an alternative of a comparable standard, if available. If this situation does occur we will not make any refunds unless we obtain refunds from our suppliers, nor can we pay any compensation or meet any costs or expenses you incur as a result.
We regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation.
5. Force majeure
In a situation of a ‘force majeure’, Partycroatia cannot accept liability or pay compensation.
This would be in situations of where our contractual obligations cannot be met to our best performance or standards due to means outside of our control. In these booking conditions, ``force majeure`` means any event, which we or out suppliers we have contracts with are not able to, even with all due care, foresee or avoid events, such as; war or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control. Partycroatia does not take responsibility or has no liability of any affect, suffer, damage or loss resulting from a ‘force majeure’.
When booking with Partycroatia, you as the consumer automatically agree that in a circumstance where there has been any damage or loss caused by you/or a member of your group, the responsibility falls in your hands. As an individual or group, full payments must be made for any damage or loss direct at the time of the supplier, manager, accommodation owner.
If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with your own and the other party's legal costs) as a result of your actions.
If in an unlikely event that your are dissatisfied with Partycroatia or any of the companies that Partcroatia are contracted with that provide services. The first action that must be taken is that a representative must be immediately informed to the relevant supplier. Failure to immediately notify the representative/supplier whilst on your trip deprives them/us of the opportunity to rectify the situation and issue. If this step isn't followed your rights under the contract may be affected.
If your issue hasn't been resolved and you still remain dissatisfied with the service provided to you, you're next step is to write to Partycroatia within the next twenty-eight days of you returning home from your trip. A receipt of acknowledgment of your correspondence will be sent to you and a response by a Partycroatia representative will respond to you as soon as possible. No complaint will be accepted after the twenty-eighth days of your return, and it will be assumed that you are fully satisfied with all bookings made by Partycroatia after this period.
The contractual terms and conditions of the companies that provide the transportation for your travel arrangements will apply to this contract. These may contain terms which may limit or exclude liability to you for certain events.
In respect of activities arranged by us as part of your travel arrangements, we act only as booking agent. We therefore exclude all liability for any aspect of the activity arrangements and, in particular, liability for any loss, personal injury or death. Where activities are indicated as being available it is not intended that this should be taken as a recommendation to take part. We neither own nor operate these facilities and therefore cannot and do not provide assurances that they are maintained or operated with customers safety in mind. Please note that some activities may also be considered ``hazardous pursuits`` by insurance companies and may require a premium if you wish to be adequately covered by the policy you decide to take out.
9. Late Arrival/ Delays
It is your responsibility to arrive at all departure or pick-up points at the time specified in the tickets and/or itineraries supplied by Partycroatia.
The responsibility lies with the consumer/purchased of package, and Partycroatia does not take responsibility for the consequences of lateness or non-arrival as specified above and no money will be refunded if you miss any part of your weekend as a result.
In instances when the arrival time of your flight is delayed and we have arranged airport transfers we will endeavour to hold the transfer for as long as possible but if this is not possible you will have to make your own arrangements to the destination required. Parycroatia does not cover the costs of additional travel arrangements, if in the situation a customer has missed travel arrangements organised by Partycroatia and have to organise their own.
10. Passports, Visas, Health Requirements and driving licences.
You are responsible for the provision of necessary valid documents required for your trip including visas.
Purchasing travel Insurance is a personal choice, however Partycroatia highly recommends that every customer purchases travel Insurance, including adequate cover for any activities included in your weekend. Partycroatia does not supply travel Insurance, although when requested we are happy to recommend trusted travel Insurance companies to you. This is your responsibility and an insurance waiver form must be signed by you to this effect.
Prior to travelling abroad, you are advised to study the information given in DHSS Leaflet ``Protect your Health Abroad`` and see FCO website.
13. Privacy and personal data collection and utilization.
Partycroatia Is obliged to protect customer’s personal data and ensure that all personal information collected from you will be held confidentially and only shared with specific organisations/entities to secure bookings for your accommodation, personal water craft, party boats/yachts, festival tickets, Club/VIP entrance, concerts, transport, day and evening activities or the like. This information will not be shared with any organisation or entity other than the defined terms. Partycroatia keeps private information secure and strictly confidential, only in use for employees who require the information that is necessary to complete their job. Creating a peace of mind for every customer using and purchasing on our website.
14. Decleration of security.
T-Com Pay Way applies the most modern standards of data protection - Secure Socket Layer (SSL) protocol with 128-bit encryption and MD5 algorithm. ISO 8583 protocol ensures that the data exchange between T-Com System and the authorization centers of credit card companies is done in a private network that is protected from unauthorized access by double-layer ``firewall``.
